lost my harship case, how bad does it have to be?

went to court yesterday to have my stay lifted on the grounds of hardship.... what a joke. both me and the other half are unemployed job seekers since early december, 3 kids house and all that comes with it:mad:

judge said i can't rule in your favor "TODAY" what did she mean?

my final comment in court was " how bad do things have to be before courts will rule in the consumers favor?

everything i read in Banking print and on money expert points you to go to court and clain under hardship..... so i did, paid my £75 and got no where, what did i do wrong i ask

no sure how today will help me or whether i should appeal against the ruling yesterday

HSBC owes me £4750, maybe i should have excepted the £3077 they offered me back in June 2008, thing is everyone at that time was getting a full pay out and i thoought i should too

any advise out there please

  • yeah i think you should of accepted it you could of still had the remander put on hold to claim after the test case iv had my hardship case in since aug last year and have nt had any offer mine is for 4759 and id defo accepted anything over 2000 i have balliff letter eviction notice the whole job lot but they still wont accept am in hardship

    I would never have gone back to the court to lift a stay on the basis of hardship, however, there is nothing that stops you going back to the bank with the schedule of charges plus any since your claim was stayed and asking them to look at the case as a hardship one. The will mean that if they did pay out then you would have to take any amount paid as hardship off your court claim. Hope that helps.

    Could it be that the judge figured you could not be that hard up if could afford to turn down £3077?
