30ft trees in garden?

    There's no 'minimum distance' for a tree to be from a building.

    Obviously, if you were planting a new tree (as you say you have done), then you would take into account the potential height of the tree when deciding where to plant it, as suggested by daska.

    But a healthy tree is quite acceptable close to a building unless it becomes unsafe or damages drains, when work might need to be carried out, but that doesn't seem to be the problem here.

    Sorry to dig up an old thread.

    The tree officer for the local council came out to see my, communication with the owner of the trees was getting nowhere because she was being downright rude.

    The tree officer found that the trees were 42feet tall at the highest point, the line of 3 was actually a line of 5 and that I had a good case to make a complaint because I followed the guidance to the letter.

    He went to see the owner of the trees and miraculously the next week there were men up the tree with chainsaws. They are all 15feet tall now. My son is able to use the garden and my grass has gone mad, we haven't ever had so much light in the garden.

    Perseverence is the key in these matter I think. Thanks for all your help and advice. x

    My OH's bachelor pad was one of four semis in a close, edged on one side by a large garden which had huge leylandii trees along the boundary fence. The landowner originally sold off his land to a developer who built the whole estate.

    OH's house was full of spiders and moths (and I mean full) and it was a constant battle to stop them taking over! In spring the houses and cars would get covered in the pollen from these leylandii.

    The whole estate complained to the council and the council put an order down to cut the trees back to 15ft. The landowner ignored it and was given an ASBO.

    Still, he did nothing and the council seemingly seem powerless to do anything, as the only option for them now is to get a court order to have access to the land, cut them back themselves then try to get the money out of the landowner.

    To top it all, somehow this landowner managed to get himself on the Parish council! You would think having an ASBO would prevent him, but apparently not!

    Luckily, OH sold his place so we no longer have to worry about it, but the battle continues.

    Sadly, the moral of this story is to look very carefully at the garden and tree situation before you buy! It doesn't cover you 100%, as anyone can plant what they want (as a neighbour of mine did in my old place in London - a eucalyptus two foot from my greenhouse which was likely to reach 75ft in ten years!) Even asking the neighbour whether he realised he would be blocking my light at the greenhouse - he just shrugged his shoulders and said that I could always move the greenhouse!). But at least you can take photos before and after as soon as you notice that a plant might cause you issues in future to strengthen your case.
