Can I get my CC charges back via cheque?

Hello folks, I hope someone can give me some words of wisdom!
I've been trying to claim money from Egg. It's gone as far as the Financial Ombudsman, who say that Egg will pay me the full amount I'm chasing. This is great news. However, my Egg account has been with a debt recovery agency (ARC) for the last year or so now, and I'm paying them a set amount each month which I'm happy to keep on paying this. Egg say they will pay the refund into the balance of what I owe - but I was under the impression that as the money was taken from me unlawfully, I'm entitled to the refund whichever way I choose. I want Egg to send me a cheque - not put the money back into the amount owed. It'd be more beneficial for me this way, as I have other bills to pay with this amount. Is it worth me fighting for a cheque - as I've been led to believe the money should come back to me whichever way I choose. Anyone been in this situation? I appreciate any advice!
