Can anyone please help me?
I wrote to Capital One on 2nd February with a request for my statements and a cheque for £10, a couple of days later they sent me a letter which offered me £232 in refund of charges and £20 interest - this being the difference between the £20 charges and the £12 charges since opening my account but no statements or list of charges. On 7th February I wrote back with the second letter template but added a bit saying that I also wanted a list of all my default charges or copies of my statements as they had already cashed my cheque. I then waited and heard nothing........... On Friday 20th I decided to fax over my letter of 7th February to them as they denied ever having received it. Today I phoned again to ask if they had received my fax and if my statements had been sent out etc and they told me they were sent out yesterday:mad: :mad: :mad: !!! When I phoned last week I was told they were sent out the day before too:mad: ! When I phone up the customer service department they say that they cannot help any further as everything to do with the charges is dealt with by the Executive Office and they have no telephones in that department. What can I do
?? I think that Capital One have purposely not sent out the statements/list of default charges so that they can delay and confuse matters. From the statements I have got and from working out how many fees there were that were £20 I estimate that my fees over the last 5 years since I have had the account are in the region of £1100 plus interest so obviously I dont want to take the £252 offer. I feel like I am a bit stuck now though because I cant take them to court due to the fact that I dont know the amount I am claiming for as they havent sent me the statements so do I just need to wait 8 weeks then report to FO?

I believe that they have 40 days to respond with duplicate statements as you have paid the £10.
If they do not respond within that time then you can report them to the Information Commissioner (IC).
I have no idea what (if any) sanctions the IC can impose.0
