bit worried

got this from capquest today it says we havnt been paying but we have with payplan any advice please have tried to phone payplan but it went to answer phone thanks

    I notice they do not refer you to the Office of Fair Trading for guidance, which most creditors seem to do. Also that they give you an 0870 number to contact them on, so you pay them for the privilege of phoning them! I suggest you keep trying payplan as a matter of urgency, I am sure they will be able to help. Certainly they need to be kept up to date with developments.

    MOST of the time statuatory demands are just a delibarate attempt to frightn you into paying up. Generally used by 1st crudit who use them like confetti, but crapquest seem to be catching on.

    The BIG advantage from crapquests point of view is that they can print a Sd at no cost other than the paper and the postage whereas othe court proceeding require them to pay a fee up front.

    The downside is that if they want to make you bankrupt, they have to pay about £1500 in fees and have no guarantee that they will get that back, even less that they will get any of the principle back.

    Do you have a lot of equity in a house?

    Have you requested the CCA previously?

    And have you had a chat with NDL, who are probably better advised to talk you through this than payplan?

    Also - do not talk to them at all. Everything must be in writing.

    thanks for the replys i dont own my house and the debt is for £812. I havnt requested a cca will do that now

    Well, they will not be spending £1500 trying to get you to pay off a debt of £812 when you have no assets if they have any brain.

    However, brains are optional at DCAs, so speak to NDL about setting the SD aside.

    and complain to the OFT re capquest. Ist Crudit are in trouble for the same antics.

    I had a letter form a creditor saying I have been paying but no arrangement had been made, I just continued to pay via Payplan.

    I'm starting to hear on this forum that people aren't happy with Payplan. I mean I don't like that they remind you about their cover & insurance but I just ignore it. Should I move to CCCS?
