Does my GF need her ASU now shes on Maternity leave?

My girlfriend is now on maternity leave and I'm wondering if she should cancel her ASU insurance cover.

She has no plans to go back to her employer but she will start up child minding.

Can her current employer make her redundant while on maternity leave as if she lost her pay we wouldn't be able to pay the bills (we'll, it would be very tight).

She pays £22 a month IIRC so a potential £198 can be saved. I know many people think they are a waste of money at the best of times :confused:

    I can't see a problem with your wife cancelling her ASU, but please let others give their opinion as well.

    Your wife's employer should not make your wife redundant whilst on maternity leave, if your wife has her works contract check on that, and if any problem with the employer if your wife is not in the works union, she can contact ACAS. (you can google these in the search panel).

    It's a bit of a funny one this as she has no contract, I know, I know, it's not a very good place to work but she did enjoy it (for quite a number of years) and it paid the bills. The place was also near mine so we could car share (a big saving not having to run two cars).

    What annoyed me is that when she got paid, the woman who ran the business gave her a cheque rather than BACS the money straight into her account. She got a P60 and wage slips so everything looks above board but still a minor inconvenience.

    So your wife was never given a contract then as you say?

    If your unsure of anything in regards to her employment, maybe it would be best to ring ACAS and see what they have to say, I assumed that its a legal document within 2-3 months of employment to have received a contract, yet I could be wrong.

    However, there may be a thread for this on this site, I've not yet seen it myself but I expect there are threads here for that purpose in case of any problems, so maybe you could check them out if you have time.;)

    I take it your wife used to get paid by BACS then and suddenly gets paid a final cheque payment?
    So if your wife was handed her P60 isn't that the document you received when you actually finish work? (If so I take it now that your wife is on leave, and they are aware your wife is not returning)?

    I would be a little dubious by being paid the last payment by cheque, it may be okay.
    Did they give your wife the final pay slip as well?
    This should state for holidays owed etc?

    You will know then the correct amount was paid in the cheque.

    My wife (girlfriend actually) hasn't left work, she's just on maternity leave. They don't know she's not returning in 9 months.

    She has always been paid via cheque. I was just saying it seems a strange way of paying staff these days :confused:
  • My Mum works for a small company. Owned and run by a more senior in years man. He pays by cheque. He doesn't like these computer things. He would rather pay someone to work out the pay roll and then he writes the cheques out. She gets it on the last working day of the month.

    I taken it your wife has already left, when you mentioned about the P60, sorry my mis-understanding.;)

    Yes I agree, its not a very common way of getting paid by cheque really is it?
    As long as she receives her pay slips to know what is what, I think it must be okay.

    I would agree with the poster who suggested phoning ACAS. If your girlfriend doesn't have either a fixed term or permanent contract she may not be covered under her ASU policy. I think there would be some kind of loophole that means she is classed as being on a contract if she has been there a certain amount of time but I'm not certain so would definitely be looking for clarification.
