If Company Does Not Resond By Deadline In Letter Are They Liable???

Hi All,

I sent off my first stage letter to Black Horse which they responded by refusing our claim. I then posted my second stage letter (copied from this website) and sent this recorded delivery asking for a response within 14 days of the date of the letter (letter dated 07/02/09). Black Horse signed for this letter on the 12/02/09, however as I had still not heard from them I phoned them today. Black Horse say that they have no record whatsoever of ever receiving this letter, I have heard through the grapevine that if they do not meet the specified dates in the letter sent this means they accept liability .. is this true?

Black Horse advised me to email the letter across to hem which I have now done. Any advice would be greatly appreciated.

    Hello there

    In total they have 8 weeks to respond.

    For example, if they responded to your first letter within 5 weeks, then realistically they should only have 3 weeks on the 2nd response, that obviously makes the full 8 weeks, that is what I was told.

    However, if they do not respond at all you can contact the Financial ombudsman service to see if they can now take over your complaint.

    There is no harm in contacting them anyway as they may offer to send details to the company on your behalf and take it from there.;)

    To my knowledge they are not exactly liable as there are other ways this complaint can be dealt with.

    That does help, I think I got confused because the time frame stated on the second template letter was 14 days. I may contact the FOS tomorrow. Thanks again for your response. ;)

    Hi hun not a problem, some do actually give 14 days on the 2nd letter to respond, but the timescales they are allowed is that of 8 full weeks.;)
