finally had a letter from la redoute, sending - what they say - is the credit agreement for my daughters account with them.
its crazy!!! the agreement is called 'credit agreement and your statement explained' but there is just lots of blank spaces!! her name and address isnt on the agreement, nor is it signed by her. the space for her customer number is blank.
in fact there is nothing on there to say it is hers and it could be anyones!!!!
can i assume it is safe to say that is isnt enforceable??

You need to be careful with La Redoute, I queried My agreemnt (same as yours) and although they put my account to zero they also put a black mark on my credit file. Which they are not allowed to do but did anyway. They did take it off again after a complaint to the FOS. But only a court can rule it unenforceable not the FOS.DS1 12/10/04

so whats the next step?? do i send a copy of this agreement to someone??
they are still bleeting on about the PPI on the account as well. even though my daughter didnt ask for it, they say they willnot refund anything because at the time, they (redcats) werent regulated. to me that says that they were a law unto themselves.
a blank (completely) agreement isnt worth the paper???

an update here, for all of you who are having problems with la redoute.
on an earlier post i told how even though the account is in dispute, they had employed the services of a collection agent. the last communication was to tell the agent that my daughters complaint was now in the hand of the financial ombudsman and as it was in dispute, they could return the case to la redoute.
nothing further was heard.............until today.
ANOTHER letter from the collection gent and a very odd letter indeed.
they are saying that there was an arrangement reached between them and my daughter (news to us!!!) and that the agreement was to pay £32 a month to the agent, and she hasnt paid so they are now taking it further.
there was never an arrangement reached, we never had any other letter from then about this account and hey, are they going to get a letter back from me!!!!! and i will want copies of everything they say was sent, agreeing to this arrangement.
my daughter doesnt have a phone, so everything is ALWAYS done in writing.
has anyone else had this? are they trying to pull a fast one??0 -

Here is something I posted in the CCA requests section. Sounds like I received the same blank form.
"Ok... received my reply. 3 pages long addressing my complaints.
Firstly they state my 'account is not in dispute'.
They believe, and I quote "we have complied with Section 78 of the Consumer Credit Act 1974 by providing 'a copy of the credit agreement that was in operation and which was supplied to you at the time you opened the account, together with your account information, all of which has been compiled manually by a member of our staff."
Then, in section 3 of their letter they go on to say "we have been unable to provide a copy of your signed credit agreement, as you did not return this after you opened your account" (- er, you never sent me anything to sign and send back!)
We have consequently decided that it would be inappropriate to persue the outstanding balance on this account. Please note that we have consequently not attempted to collect payment on this account after receipt of this letter dates 19th February and a freeze was placed on yoru account.
So, big thanks to all who have helped me with this. My question is now, can they pass this dept on? They say they will not persue, but can a DCA ?
Also, they go on to say 'we will keep credit reference agencies up to date with details of who our customers manage their accounts - details of missing payments and any defaults assocaited with your account remain on your credit file'.
I understand this will stay on my credit record for 5 years (Scotland). Is there anything I need to do with refence of writing to Experian/Equifax ie: a notice of correction?

what did you do after receiving the standard blank form?? yes we had one of those as well.. you must have done something to get the response that they werent pursuing the balance. my daughters balance now is soley bloody charges. (sorry but so cross with them). i may try your tactic.
i have sent everything to the financial ombudsman in the hope they can do something.0
