Getting a refund from HSBC for XL collapse

hi every1,
was just wondering if any1 is trying to/got a refund from HSBC yet with regards to the XL collapse. I was advised I cudnt get refund from ATOL as i paid deposit on CC.
I then spoke to HSBC who are our CC company who have declined me once saying I need to deal with retailer Direct which is impossible, therefor i re opened the complaint and was told it was being looked into that was 3 weeks ago

Check out the thread: What to do if you've been affected by the XL collapse.
A lot of people are having problems as you will see. But you should be able to claim back from your credit card company under section 75. There is a useful bit of information from Martin on this board about it (see right Financial Crisis). Quote it to them and see what they say. Have you tried to claim from ATOL yet?0 -
yes i have they said because i paid part on cc i was to claim back from my cc provider just spoke to my bank AGAIN sent them everthing from a copy of section 75 to confirmation of xl collapse and still they are refusing to pay out. they are saying that as they are unable to recover the funds from the supplier they are unable to refund me0

Was the deposit over £100? If so, and you paid by credit card they are liable for the whole amount under Section 75 of the Consumer Credit Act. I would contact the Financial Ombudsman and tell them what has happened. They are very helpful.0

thank you apparently it is still being investigated even tho i have raised the same complaint 3 TIMES!!!! if no luck will FO thanks0
