Rental Property and EPC

Hi
I've been letting my flat to tenants since August 2008. The tenancy agreement was for six months and we have just renewed the AST for another 6 months with the same tenants.
Now the letting agents I am using are saying I must get an EPC. However, my understanding was that beacuse these tenants moved in before October 2008 and they are remaining I do not need an EPC. I would need one if different tenants moved in. The letting agent is saying that as we have signed a new tenancy agreement, this constitutes a new agreement regardless of whether they are existing tenants, and I therefore must get an EPC.
I don't mind paying the fee for arranging this and know I will need one, but I just want to know whether in my case I need one yet.

Naf20 - your own interpretation of the rules is the correct one. EPC only required for new tenancy starting after Oct 1st 2008, with new tenant.
The EA is probably going to make a recommendation to you on which EPC assessor to use- kerching!;) Tell them to go and familiarise themselves with the law. For your own info see this link - look under "What about tenancy renewals" towards the bottom of the page. You can also check with your own local Trading Standards Office - they are responsible for enforcing the EPC regs.
Have you checked that your EA knows what they are doing with other things like tenancy deposits & gas safety certs etc?

Thanks for your reply, I thought I was right! but needed reassurance first.
The LA are fine with everything else and I have the deposit registered and all other formalities in place.
And guess what - they have recommended an EPC assessor and want £75 :rolleyes:
