    So if this lady decides to contact the CSA once the baby is born and ask for a CSA assesment for her baby they would not do it !!!
    Can they still live together !!!!

    They will do the assessment but it will stay on CS1.

    It would involve phasing which won't help, in fact it could make it worse if the new partner puts in a new claim.

    Having the baby MAY make a difference to the assessment depending on all the other factors. If you want, you can PM me with the details and I will give you a revised figure based on what your situation will be.

    Even if the NRP were on benefits and had a £5 per week assessment, that doesn't include arrears. Arrears are added to the normal amount of assessment - sometimes they are frozen and not collected for a while, but if the NRP is not on benefits, then this won't happen. It is likely that the assessment itself may reduce due to the new baby but that may not reduce the amount payable due to the arrears. How much are the arrears outstanding? Reason I ask, is that CSA are being very strict at the moment with regards collection of arrears, and want them back as quickly as possible - so even if you had a £5 assessment, it may mean no change to your payments in order to get arrears paid off.

    we havent called them yet but we did have some good news - he randomly had a letter through saying he only has two months worth of arrears to pay now anyway, so that will be one lot gone at the end of the week and the last lot next month, thank god! unfortunately the jobcentreplus have got a back log of 6 weeks for MA so we wont get any paperwork etc on that side to send them until we have a 1 month old baby at this rate :rolleyes: by which time the arrears will be paid off which is all good! finally something positive on the money front!! thank you to everyone for your help anyway.

    just saw this after my other post this morning. actually, yes i do think its ok for him to pay £5 per week for his first child, and if you like me to justify it i can post you our SOA - we are both on DMP making minimum payments to our creditors and as i said before we have only £100 per month left over for nappies, food, emergencies etc - blood doesnt come out of stones unfortunately! the mother of the 7 year old child doesnt have a job and has never had one, she claims benefits and as i understand it she gets the csa money deducted from them anyway. maybe if she had a job and used the money to benefit her income i would be more sympathetic towards her but it doesnt make any difference to her actual money in the bank! there is no reason for her not to have a job other than she has never had one in her life, not even a saturday job at school/college!

    Not so. If she is on benefits she can keep a certain amount, it used to be £10pwk, think it may be £20 now, I'm not sure. I do know plans are afoot under new CMEC rules that would allow her to keep all of the CSA money paid and keep her benefits.

    There has also been talk of making single parents work once their children have reached a certain age, so she may not be able to just claim benefits indefinately.
