Hey, thanks, thats a good letter.
You guys are making me feel better allready..

If the worst comes to the worst. will CCCS help me pay back the debt in payments I can afford? If they don't accept offers will they then take me too court. Will the courts be more ammenable to lower monthly payments. I'm on sicness benefit at the moment and will be for quite some time.
I'm looking forward to getting a job and kicking the debt into touch at last.

I think CCCS have a lower limit on what you must owe and pay per month before you can set up a formal DMP. Paying £100 a month I think.

But short of that they can help you out with advice and letters to negotiate yourself.

If you are on just benefits the courts would most likely set a low or token payment even if it came to that. MH know that, so they wouldn't want to go to court most of the time.

See what response you get to the letter above first of all though.

The Courts will certainly be sympathetic towards your financial circumstances.

Even so, I'll bet £20 to your £10 that you won't be paying a penny towards Halls if you take the advice of the people on this forum.

    28 weeks - only 12 to go!

And fermi I think I was perfectly justified - now what shall I eat first? The marsbar or the bounty bar? Hmmmmm HMMMMMM ;)

dodger - once the debt is statute barred and especially if they also can't find the original agreement the chances of a CCJ is minimal :) Please don't loose too much sleep over it :)

Speak to Payplan or CCCS - their advise is good - but bear in mind that they will usually not advise you about statute barred or unenforcable debts. That's not what they're for :)

Personally I would send the statute barred letter Fermi posted (clever clogs! mmmmmm mars bar... mmmmmmmm) and wait and see what they come back with :)

  • My elderly mother has rec'd a letter from them too - addressed to my sister who emigrated 12 years ago & moved away from home at the age of 18, so has never lived at mother's address !! To my knowledge my sister has never had any CCJs or debts.

This sort of correspondence is quite upsetting for someone elderly to receive & naturally sent mother into a tizz ! worrying that my sister may get stopped at the airport when she visits............

Question is do I respond on mother's behalf to MH telling them this & so possibly end up receiving more unsolicited correspondence from them or would I be better off just shredding the letter ?

    Any advice would be appreciated.

Probably best to just ignore it.

If anything more comes through, then just put back in the postbox as not known.

It is entirely possible that they are just looking for someone of the same name anyway. Either way they are "fishing" and obviously have no clue where she (or this other person) is.

Please reassure your mother that there is zero chance of her being stopped at the airport or anything like that. Debt is a civil matter, so nothing like that can EVER happen.

If anything further happens about it, then pop back. :)
