debt collector calling at house pls help!

hi everyone,
long story short, my daughter owes a debt to abbey, moorcroft took this debt on and have now sent a most peculiar looking fella who turns up in an old battered van wearing a baseball cap not at all proffesional looking!
i have dealt with him as she is too young to cope with this, i told him she had written to them requesting that all correspondence to be in writing only and him calling constitutes harrasment. he did in the end go away after trying to tell me there would be a ccj registered at this address and it would affect me!! i put him straight and said he needed to get his info correct that it does not register at an address it registers to a person and in no way will affect our credit file as we are not connected financially.
he also said it will now be processed and go to court and bailiffs will come and remove my goods!! erm i dont think so its not my debt and my daughter does not own my items.
so just really for clarification i am right in that fact arnt i that they cant remove my goods to pay her debt??

Yes you are correct although unless you can provide receipts, I'm not sure how you would prove that they belong to you. Your daughter needs to sort it out really before it gets that far.
If the peculiar looking fella was just a debt collector sent by Moorcroft, then he has no rights whatsoever and can't take any goods away no matter who they belong to, only registered bailiffs can do that.
Someone will come alomng who knows for definate but I'm sure that bailiffs don't get involved until a CCJ has been obtained and your daughter has defaulted on it.

Spot on.
A bailiff shouldn't be able to touch your goods for her debt.

You are right but in terms of providing receipts I think is a bit of a grey area. I once had a lodger who did a moonlight flit (long story!) and owed tons of dosh. Anyway, the bailiffs came round one night and actually told me that they could not take my stuff but wanted to check that he was no longer here and wanted to see if he had left anything that they could take. I'd had a lot of my stuff for years and thus had no receipts for them and the bailiffs admitted that they could not prove that it wasn't mine so went away and that was about 5 years ago!
So I wouldn't worry about receipts and things as most of us chuck them away after the warranty has run out anyway!Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free

Its down to the you to prove that you own the goods.
Im going through the same thing at the moment and unless you can prove that you own the goods in your house, then they are legally entitled to take what they want.
Its a stupid rule but its very clear that it is down to you to prove ownership and not the bailiff0 -

If shes old enough to have run up the debt, shes old enough to deal with the ramifications of it! Please dont sheild her from it! She needs to learn all she can of how to protect herself. I agree she should cme here and get help with it.

she did have income but was made redundant the day before christmas eve.
i cant see there being a problem in bailiffs realising that we do infact own the stuff in our house, we are both 40 odd years old been homeowners of the house for 12 years im sure it will be blatantly obvious that she does not own our goods in our home. she is 20 just turned and am sure they would realise we dont lodge with her!!
im not protecting her from it, i have told her she has to deal with it, nor am i willing to pay it for her, by saying i was dealing with it i just meant dealing with the guy who kept coming to the door, protecting my home really as she would not know he wasnt allowed to come in ect so i have warned her fully.self confessed 80's throwback:D

I strongly doubt the guy she's dealing with is a bailiff - she'd need to have defaulted on a CCJ before it comes to that
If he turns up again tell him to get off your property or you will take legal action against HIM personally for trespass - there is also a letter you can write to state you take any rights they might have had to even approach your door away from here on back - thus making any move on to your land trespass.
That should get shot of the dodgey cap chap

You would like to think so, however a few months back i had the same problem. The bailiff turn up with a magistrates warrant to my parents house and told them they would remove goods unless receipts were produced.louiser123 wrote: »

The bailiff did not care that my dad told him that nothing belonged to me, it even got as far as the removal van turning up.
Now i'm about to go through the same thing again but have been getting some help so that this time when they turn up nothing will be left to chance.
They do not care if its obvious that the stuff is yours, they know that if your daughter has no possessions then they will try to take what ever they can.
One thing you have going for you is that your not dealing with private bailiffs who only seem interested in getting paid one way or the other0
