claiming back credit card charges and bankrupty.

in Reclaim bank & credit card charges
whats the position with claiming back charges from credit cards if you are being made/have been made bankrupt?? the charges went a long way towards the initial problem!!!

    Are you still with the OR or have you been discharged?

    not me, my daughter in law. she has only just been made bankrupt, or rather, declared herself bankrupt so is still with the OR. any advice gratefully received.

    Were the bank charges included in the bankruptcy petition?

    Wouldn't imagine you can claim back something you haven't paid but that is just me with my common sense hat on. Who knows what the real answer is. If they were able to be reclaimed then I suspect the OR would take the money anyway.

    Has she paid them or were debts to the banks etc included in the bankruptcy?

    everything was in the bankruptcy.

    I think she needs to speak to the OR and ask.
