The ban may not be enforceable legally but does the OP have buildings insurance that states the occupants are non smokers? This could potentially invalidate any claim if the property was to catch fire. Just a thought.GC Feb £95.45/£1000

Its an interesting one as a lot of landlords do say non smokers only and another one no kids, or not pets or no DHSS.Pawpurrs x0

If by the "Smoking Ban" you mean the one that stops you smoking in a pub then no it does not apply to housing including prisons.
If you mean your signs then I can't see them being inforceable either.
If you mean a clause in a signed contract then its possible that there is a breach of contract and you could. I think it would be a minor breach so you could't do much.
Plus are they smoking "in" the property? the smoking is outside.
If you dont want them as tenants serve them notice.

My niece wanted to rent a house, they said yes to the dog but no to the three year old...due to a bad experience with the carpets!
Fair enough I suppose but it was then months before any tenants move in...I imagine the amount they lost in rent would have been enough to replace the carpets five time over.0 -

as already said above, it is a breach, but one that it is very unlikely you could be evicted for.
However, if you read your agreement, you will find that you are responsible for both your actions, & those of your invited guests. So if the LL needs to redecorate to get rid of the smell of smoke, you will end up paying for this.
How often do they stay, & how much do they smoke? If the ceilings are turning yellow, you need new friends0 -
