im not sure what to do!

hi
i took a loan out about 2 years ago for 1000
the loan is with halifax
ok thing thing is i was reading about ppi and the misselling of this product
halifax sent me a loan agreement which included a seperate page for the ppi
i signed the loan but didnt sign the ppi agreement
2 days later i received a phone call telling me i hadnt completed the application properly and that it would be sent back for me to complete
when i received the paperwork back i checked through and couldnt see anything id missed on the loan agreement it was only the ppi i didnt sign
so i phoned them and they told me that it was the ppi that needed to be completed before they could process my application
is this classed as miss selling the ppi and do i have a chance of getting taht cash back?
any help would be welcome as im clueless on this kind of stuff:T

Hi there
To me this is clear that you have been mis sold, in other words its like they have made the PPI as part of the application.
Write to them and complain and reclaim.

There is more reasons as well if any of them occur to you write them in the letter as well, there is a letter template on the link, use that to help you but try to use your own words if you can.
They have 8 weeks to respond in full, another letter maybe required if not successful first time round, or until you receive the final response, if still not resolved you should be able to take this to the financial ombudsman service (FOS), they will let you know that in the final letter with a leaflet of the FOS complaint procedures.

As you said they rang you about this, it may also be a good idea to request a SAR (Subject access request) where they must provide everything they have on you, they have 40 days to comply, and any recordings taken in the calls they should enclose those as well, which may come in handy to back your complaint.

Just an update on the capital one ppi process.
I have been in contact with capital one and they have sent a final response stating that i apparently took out the insurance 2 months after my initial application (6 Years ago over the phone) i apparently received the documents for this also but i cant ever remember receiving them and i cant remember buying insurance over the phone. I have now put this in the hands of the financial ombudsman as i feel its my word against theirs. This wouldnt have come to light if i hadnt asked for the PPI to be stopped. (One thing i have got that Capital one sent to me is the original handwritten application i made in 2003 so thats a bonus)

If they have been taking PPI premiums and you never signed it then they must return the funds to you for taking money from you without your consent. I would FIRSTLY consult a lawyer for one reason only:
This breach is more than just a "mis-selling" issue. You could find that the severity of the error could entitle you to additional compensation.
The bank will play it down of course but seek some advice first. If you cannot get extra compensation, then go thru the usual channels, Di is good.
This may constiture fraud on the banks part, hard to tell at this stage. Check it out. If they never showed you this extra sheet of PPI paperwork at the time of the loan applcaition, then I think it could be more serious that just mis-selling...0
