HFC Loan Payment Protection Insurance....help!!

Hoping someone cal help as am new to all of this....

I genuinely believe I was mis-sold my loan payment protection insurance back in 2004. We were recently clearing out some paperwork and noticed it on the loan agreement (box was pre-selected) and it got me thinking because I was basically told it was pretty much non-optional and left thinking that a part of the agreement.

Anyway, I have followed the steps on here and sent a first letter to HFC back in November outlining all my issues. I recieved 2 letters back from HFC - one saying they had recieved my letter, the second at the end of December saying they had as yet been unable to resolve but would be in touch shortly. I then sent another letter at the end of Jan saying that if I heard nothing more in 14days I would go to FOS - which I do plan to do as this is a joke. I have heard nothing more from them.

Just wondered if anyone else out there had complained to HFC about their PPI and what the outcome was? Any tips on what to do next is greatly appreciated - should I phone them, or just go straight to FOS?

    And welcome.

    I would definately just continue to go to the FOS now, they have had plenty time and 8 weeks was ample time for them to resolve this.

    You may be aware that this company were fined for mis selling PPI, if you google this in you should get some further info on this.

    In regards to the FOS you can either ring them for a complaint form or download from their website.

    Send any correspondence you have received (copies) to the FOS to enclose with the form and also explain the 8 weeks have well passed the 8 weeks they had and as they have not resolved your complaint and not even got back to you - you want this investigated by the FOS themselves.

    I would also get some photocopies done of the complaint form, keep one for yourself and also send a copy of this completed to HFC, tell them you have now passed your complaint on to the FOS and have enclosed a copy of the complaints form for their records and interest, in fact this may shift them and hopefully it will be good, if so then just confirm this to the FOS.

    I too have put in a claim to HFC as I know I specifically asked not to have the PPI and they still went ahead and added it, I sent the 2nd stage letter and I got a letter from them 4 days over the designated 14day deadline and they wrote back saying that 'based on the limited information that had available they would be prepared to offer to pay me approx £1,000'...
    (I will post the details shortly).... Well, this is rather a lot less than what they had initially taken at the beginning of the loan,so I am in the process of drafting a letter back to them. They take their time to respond to anything I had 3 letters between Dec & Jan advising that 'they were still investigating'.

  • Yeah they do seem pretty relaxed about responding.

    I think I plan to phone them and ask what is taking so long. I then fully intend to progress to the FOS but want to at least talk to them first.

    I have seen a case on here where they were successful in being refunded - so it does seem that they offer this in some cases.

    I have paid over £2k so far and would be keen to stop this....

    :confused:Not good news for me....finally got my letter from HFC. I called them to chase last week and it arrived on Thursday. They've said that they have reviewed my complaint and have been unable to uphold. They have said that they belive that PPI was discussed and the policy details sent to me for my perusal and that it remained my decision to make in the comfort of my own home....!! They said that it was my decision whether to tick the 'yes' or 'no' box (which actually I had already stated as part of my complaint was pre-selected 'yes' before I even got the paperwork. They have said they believe they met the disclosure requirements of the ABI Code of Practice, which they complied with at the time. Basically they have said that they believe the policy was sold to me correctly. All they've done is cancel my PPI and refunded three payments I have made whilst this has all been going on....but as a credit to my loan account. So, I think I am going to have to take this to FOS.....grrrrrrrr.............unbelievable.

    PPI refunds CANNOT be credited to your loan UNLESS you state so - they must offer you the cash refund. If they are prepared to offer a three payment refund - then there is an element of guilt on their part?

    Continue - they won't lay lie down over it. It's worth harping on at them and demand answers - and demand proof that they are correct.

    The box was pre-ticked therefore it gave the impression that it was a necessary and needed commodity. By it's very nature, it was misleading.

    IF there was a free choice to tick YES or NO, then why was the box pre-ticked to YES at all - and why not pre ticked NO..?

    I would demand more answers and accuse them of mis-selling, misleading and not providing a fair and reasonable service under the Business and Services Act 1982 (think thats the right one)....

    Thanks so much....yeah I think their letter is pitched in such a way that makes me think they dont really have the proof and are just trying to get rid of me. I have just done my pack to go to FOS as I am not going to take this first response - although their final, they have taken 3 months to get to it!!! You raise a couple of really good points, so may add a note in about this to my pack as I do think their agreement to refund 3 months onto my loan is not on and suggests guilt.....also they have said I had to tick the box...but it was absolutely pre-selected and next to wording that says the 'strongly recommend' it is taken. That paired with the fact that I was made to feel I didnt really have a choice when i took the loan all made me feel forced into it.....I'll keep you posted

    sorry to hear this.

    If you've not done so already as it seems like they have fobbed you off here, have you requested your paperwork for when you had taken this loan out.

    If this was over the last 6 years, you could request a Subject access request (SAR), they have to supply everything they have on you, this may be interested and if any phone calls recorded etc, and the info for when the loan was taken out.
    There is letter SAR template on the thread for this with details, they have 40 days to comply, but there is a payment of £10 cheque or postal order payment you must enclose with the letter - post by recorded delivery.

    There may be something within the SAR to back your case, fingers crossed but keep at them anyway, good luck.;)
