Advice on noisy neighbours pls?

  • Ah that's great! where we live he's sort of surrounded by about 6 neighbours via the gardens and I think including me 4 of us have children so he could put two and two together but can't prove it's me, phew! Thanks again for the info, it's been a great help!

    The lady who used to live next door had hearing difficulties and didn't used to wear her hearing aid so sometimes I could mute my tv and just listen to her audio...

    The lady next door now has 2 dogs and leaves them in the house all day on their own so they bark and make other noises most of the day....:sigh:

    Lol ah glad you got it sorted though and I'm definatly going ahead with this, he has dogs also (i'm sure they are the banned ones? american pit bulls or something?) he has 4 of them locked up in a scruffy shed thing always outside and he's known or was known for fighting them, they are awfull dogs, I couldn't let my kids or my own dog out in the garden as they barked and tried to get over the 6 foot high fence!! (he had bikes etc leaning against it so it could have been possible?) and they bark constantly, at least now after I said 'look i've seen the dogs trying to vault the fence when the kids have been out' has he done something about it but only on my side, I can see they are an accident waiting to happen, very scary dogs they are!

    Dont bother ringing the council or environmental health.

    It is clear that they are unaware of how easily noise transmits.

    It is therefore your mission to demonstrate.

    Get some music on /do some drilling when you know they are having quiet time !

    Do it until they come and speak to you then point out that you appreciate how disturbing it is as you often hear their noise also.

    Point out that as the walls are apparently so thin,you could both try hard to be more considerate and make less noise.

    Sorry to hear about your problem. i can sympathise with you as we are going thru same hell.
    Firstly it is not a police matter but an issue for environmental health.
    They are quite helpful. They would send you a diary and at the same time write to neighbours. It is hoped that at this stage it would stop. (in my case it didnt)
    After completing diary, they would write to them again. ANd they would also ask you to call them so they can witness the noise nuisance. If they witness it, they would serve your neighbours a noise abatement order under the environmental act.
    After this, the would provide you with further diaries in order to ascertain any further breach. (you would think after all this, some human would stop, in my case they didnt)
    For every occasion that the generate further noise, it is classed as a breach. The more breaches, the higher the fine/penalty.
    If there is evidence of a breach of this order, the environmental health can apply to the magistrate court to get a warrant to enter your neighbours premises and seize any noise amplifying or sound equipment.
    And they can also take your neighbour to court as well to get a fine.
    As for us, our neighbours music/sound equipment were seized 2 weeks ago. Normality so far.
    It took us 6 months to get to this stage from the first time we complain to EH. Not becos they were slow but cos these neighbours were playing start and stop games...trying to confuse EH.
    I wish you the best but pls ensure you complain. YOu are entitled to rest and peace within your own home

    btw my ex was attacked by a staffordshire pitbull terrier - he has a massive scarring all down his leg - looks like a shark bite! according to the Dangerous Dogs act these dogs when in public should be muzzled

    i wouldn't like my kids out playing with these dogs about to be honest

  • pssst weird thing is, they never seem to have a quiet time, she's not often there or at least I don't see her every day and when he's there he's always working on the house, only time I think they/he might have a quiet time is late at night, but I've got the children so I couldn't make loads of noise then, I wish I could try that though

    Can I ask how old your house is?? Obvioulsy older houses are not built to modern building regulations so they have limited or no sound insulation. There is some case law surrounding the lack of sound insulation and noise from everyday living. However everyday living noise is not music till all hours of the night!! I'm not sure what the neighbours are like but if they are fairly reasonable (i know some aren't)you could always pop round and speak to them! :eek:

    You can also take yourown action via the magistrates court under Section 82 of the EnvironmentaL Protection Act 1990.
