would i be able to keep my car?

  • Thanks I will keep reading - any tips greatly received - basically if i dont have a car that can safely seat 5 childnre i will loose my job as that is a huge part of my job and they require a driver with a car, in my job spec! What else can I add?

    It would be unusual for the OR to take a car that is necessary for work, that without it would mean you couldn't earn a living.

    I live in the sticks on my own with no other means of transport and the nearest bus stop is 1.5 miles away, the nearest supermarket is 2.5 miles away and there are no local shops etc whatsoever not even a newsagents within 1.5 miles but because my job is a 15 /20 min walk away for a company based in the local area they deem I do not need a car, so for shopping, emergencies etc I am stumped!:confused:
    I went Bankrupt in the middle of December had my OR interview in the first week of January within 45 minutes of the end of the interview someone rang me to advise that they will be calling me giving me 24 hours notice to collect the car. Talk about vulchers!!!:mad:

    Everything went quiet and then last week I had a call not from the OR or the clerk but some local garage or agent who said thy would be collecting the car the next day if that was okay, I said yes and arranged a time with them. The person arrived very polite and I had already made the decision not to hold anything against the person collecting the car as they personally had not made the decision - they were only doing their job... He loaded it onto a small transit breakdown type truck and we proceeded to fill in the log book details etc I said where will this be going now will it be put in an auction he said oh no... did they not say it is GOING TO THE SCRAP YARD!!! :mad: - which will no doubt cost them more iin collection etc than the value of the car.

    Now here is a scenario the V5C which is basically the logbook issued by the DVLA in tiny writing under section 5 - REGISTERED KEEPER (printed in green) on the log book document states as it does on every V5C document 'The Registered Keeper is responsible for ensuring the vehicle is properly registered and licensed C.4c - THE REGISTERED KEEPER IS NOT NECESSARILY THE LEGAL OWNER.
    If I was of the mind (but are certainly not) it was pointed out to me after I had my interview when talking with a friend who is connected with the Courts I could have said that the car was not mine although it is my name I am not the owner my father is say for example or if I had a partner my partner is etc...As they regularly see this type of thing appearing on the Bankruptcy forms.

    It appears to me and I have as many people will have seen on here through the various posts that there is no set answer I think it is a very grey area and quite honestly...the luck of the draw... because I have read posts on here from people who are in work and looking after an elderly relative and they have still had their car taken from them.
    I do feel that although every persons circumstances are individual there should be clearer guidelines on this issue...as there are guidelines they work with for other items like shopping, pets etc...

    I ask you to draw your own conclusions.....

    Piggybank I hope you put an amount down on your SoA for travel expenses. If not how do you pay for taxi's? Also you could have offered to buy the car at a reduced rate.
