Hi to everyone
Can i ask and hopefully receive an answer.
What if you made an online application (6 years ago) and then recently found out that you had in fact originally ticked the box to say that you didnt want the PPI and they have been charging you for 6 years for it?
This is what has happened to me and the CC company (capital one) have said that i have had plenty of statements so i should have done something about it before now. I only recently asked that the PPI payments be stopped so that i could pay more off the capital instead of adding to it and i was informed by a customer advisor that i had put on my application that i didnt want it.
Can anyone help?

Its not too late, if you have only just recently found out about this mis selling then go for it but act now.
Check this link out here for further information and there is a template letter on the link as well, but try to write in your own words if you can with your own reasons, check out the other reasons as well on the link that may also occur to you and add them, they have 8 weeks to respond in full, another letter maybe required if not successful first time, or until you have exhausted the complaint procedures, they should enclose details of for example the financial ombudsman service with a leaflet explaining their complaints procedures, post by recorded delivery to keep a check on the time scales they have (8 weeks) and for your proof of posting, you can check this out on the royal mail website (track and trace).

If you require more data for the last 6 years you will find a Subject access request (SAR) on the thread with details, where they have 40 days to comply and send you all information on you on your Account(s) going back as far as 6 years, there is a £10 cheque or postal order charge for this, again post by recorded delivery.
Only SAR if you require further paperwork which may back your case.

Now my brain is in gear and a bit clearer, i have looked at the letters etc but feel that they were not appropriate in this instance and im no good at rewording things but I have however contacted the financial ombudsman and they have said i have a case, as i had marked on the application that i didnt want something and they have been charging me. Also when they wrote to me (received letter today) they didnt give the complaints procedures to me, so i have set the ball rolling- thank you for pointing out the thread i read it properly this time and found the telephone number i needed for the above. Also i requested from the CC company a copy of my original application (the only thing that bothers me would they try to doctor documents to go in favour of themselves ie uncheck the box?)
Anyway we will see, we cant let them get us down or let them get away with it.0 -

You should not have to worry, these CC issues can easily be caught on they have ways of knowing how to deal with this, I think most have these worries and try not to worry about this, good luck.
Just use the template letter in that link to help you and just use your own reasons if that helps, and glad to know you have also contacted the FOS who also confirms you have a case here, great start.

just a quick question if possible (don't want to open another tread as it's a Capital one as well)
I'm thinking of claiming PPI but want to stop the payments for it asap as it costs a lot. So will i be claim if i stop the payments before i start the claim? Will be claiming on grounds that i was self-employed when i took out my card in 2005 and told that to the adviser. Or should i wait till i get all documents and start claiming?

I would write to them then to ask if they can cancel with immediate affect, not sure if this would make much difference to the new repayments though, maybe you could try to check this out first.
Have you still got the terms and conditions, even the agreement paperwork if this ?
in case you have to refer to them hun.
Some companies policies vary from one to another, but if you were self employed this can be a problem with many, again depending on any exclusions they have on this as well.
There are many reasons why you may have been mis sold and it may be worth your while checking on the list on this link here:

If you cancel do this in a separate letter.
The reclaim/complaint letter they have 8 weeks to respond in full, and write down your own reasons, as there is also a reclaim template on the link you can check out as well to help you through this.
Another letter maybe required if not successful the first time round, the first response is generally a standard fob off letter - stating, "you must have been aware, because you signed for this policy" and so on, but that is just like I said standard and there are more steps you can take this.

I have already sent a request for all the documentation as i miss a few statements from the first months and don't have copy of the contract or any T&C from 2005. But i was wondering if i stop the insurance will i be able to claim the PPi ?0

Yes you can still reclaim on the PPI, this makes no difference if you cancel or not.;)
Also if you've no agreement for this, if this was taken out the last 6 years, you can request this on its own for a cost of £1 postal order or cheque payment, this should take 12 days with request.
The SAR is still useful, but if you want to get on with things a little quicker with the reclaiming the quicker way would be to request for the copy fo the agreement as I mentioned above and the SAR should come in handy later on if required, good luck, please let us know if you want any help with the reclaiming.;)The one and only "Dizzy Di"0 -
