Can I cancel Land of Leather order?

Ordered sofa in early January, invoice quotes 8-10 weeks for delivery. Received letter re the Administration. Then got another letter on the 16th Feb offering 5% discount or free delivery of £69, which ever is better, if prepared to wait ANOTHER 10-12 weeks. Letter also said my order would be in jeopardy if I did not agree to these new additional conditions.
Can they do this?
Can I cancel order and claim deposit from CC under Section 75 yet? Or do I have to wait for all this to painfully play out.
** If I agree to the letter, it will put the original transaction date beyond the 120 day limit making it impossible to invoke the above!!
They are in breach of contract, and you have the right to cancel the order and receive your deposit back, inform them of this by recorded delivery, also send a copy to your CC company informing them that you will be holding them jointly responsible under Section 75 if your retailer does not play ball, which you can do at the same time as you make the claim from the retailer as under Section 75 you can claim against the retailer, the CC or both, although the usual course to take first is against the retailer if still in business.

We bought a suite from LOL a year ago. Reported problems within 2 months. After 8 months problems still not rectified and identical replacement suite no longer available. Store manager told us to choose different suite for exchange, we chose one in October last year (costing twice as much as the first one!) told to expect delivery in the New Year. Then of course news of the company going into administration broke.
We paid for the original suite by debit card. If LOL do fulfill the replacement order, am I right in thinking that if I pay the extra money by credit card then the credit card company will be jointly responsible if I have any problems with the new suite?

we have had 3 suites of them over 6 months all damaged and still waiting to hear from administrators, we havent heard anything the last one was delivered 10th jan 09.
we had the suite on finance cant get any info on getting a full refund.
we have been out and bought another one from somewhere else on finance also, cant afford to be paying for 2 suites!!!!!
we have phoned the finance company but they told us we have to pay for the suite even though its damaged.
tried to contact land of leather but they have told us to email administrators we have but still nothing.
HAS ANYONE GOT ANY SUGGESTIONS ???????
DONT HAVE A SUITE GET A REFUND......

Hi All,
I'm in a similar boat with land of leather. I ordered 2 suites from Land of Leather or the 28th of December. Only a week later did all the news hit the press regarding their situation. We took the whole value out on finance with their company "creation". Upon calling creation they have said they can only cancel the finance if they recieve a letter from the administratiors saying the order has been canceled. We even tried to move the finance to SCS as they use creation finance too, but that was no joy.
Trying to speak with the administrators, even 7 days after ordering they said that we could not cancel or order. Surely their would have been a law regarding canceling within 28 days?
Anyways, its mid march and we have had the corospondence with land of leather twice, once dated 16th of january saying that they was unsure whether they would be done or not and once most recent saying about the 5% discount, or free delievery.
However now we really don't want them in our home, thats if they are made/ sorted at all. we have roughly about a month left until the deadline of delivery runs out. Am I in my rights to still pursue with another cancelation request after the 16 weeks they promised we will have them, as this seems to me as a breech of contract?
Has anyone had any joy with canceling in similar circumstances or are we stuck in this for good?0 -

At the moment they have breached no contract, once they breach the contract you are entitled to cancel the order - ignore their "new offer" as otherwise you have accepted it.
If you purchased online you can reject it after delivery although you pay collection costs.
Is it any wonder LOL went bust though with so many folk just deciding they dont want their suites.0 -

I was the OP, and hadn't realised there had been some more posting going on (I probably should have subscribed to the thread). Anyway I popped back to post an update on my progress:
After taking the advice here I spoke to the administrators, they agreed that I would be entitled to a refund since the sofa could not be delivered on time (albeit they would not pay me a refund, instead the credit card company would). On that basis I cancelled the order for the sofa.
I then contacted my cc company to make a claim for repayment. The next step was a long wait for a letter from the administrators confirming that I was entitled to a refund and I should seek this from the cc company.
Once that finally arrived, I sent it off to the cc company, they then thought about it for a about a week, and now I have received a refund whilst they continue to investigate.

As long as they do not find that 'the goods were available to me' then it will be mine to keep.
Oh - and I have ordered another sofa with a very short delivery lead time!0
