Red/Lowell selling a disputed account to Mackenzie hall

As the title suggests!

I disputed a Red/Lowell letter on 06/10/08 and have heard nothing from them since then had a letter at an old, old address stating that collection was imminent etc etc.

Only difference was this one was from Mackenzie hall . I was under the impression that this was not allowed and made the debt void?

Am just writing up the prove it letter to mackenzie hall but wondered if there was any other action i could take.

While a debt is in dispute, it should not be passed on to anther DCA. I would point this out in the first paragraph of the letter you send. Make sure it is clear that you dispute the debt and passing it on is a breach of the OFT debt collection guidelines - then just continue with the provie it letter.

I will suggest you check your equifax report also. Mackenzie Hall has left several foot prints on my equifax credit report.
  • Hi, Not sure if this should go here but it's the same two companies....
I had a phone call tonight from someone from Red! (I didn't know who they were so refused to give him my details when asked.)
He then said it was to do with Lowell and I said I know them so he asked for my details again which I refused. He said that they'd written several times - incorrect. The last letter I had from Lowell (not had one from Red) was last August when they couldn't supply me with the credit agreement I'd requested and they had closed their files and that no further contact would be made regarding the account.
When I checked my credit file with Experian, there is a default on there from Lowell - should that be there as it was a disputed debt?
When I wouldn't give my details over the phone tonight he said he'd mark it as I'd refused to speak to them and put the phone down!!

Any ideas what's going to happen next & what I should do?
(This was all started from a Providian/Monument credit card debt.)

Any help greatly appreciated & sorry if this is in the wrong thread.

    Hi

Red and Lowell are the same company under a different name. Report them to the OFT and trading Standards.
If you've have not made a mistake, you've made nothing

Hi, I had a letter from Red this morning asking for -
    1. an amount of money for our client (Lowell!) to close your account.
    2. A monthly repayment amount.

The date of the letter is 23/02/09 & they give 7 days to reply!

I emailed them with a copy of the last letter from Lowell (or them!?!) saying the files were closed!

I can see from the letter format that they are the same company as Lowell - it's exactly the same apart from the name!

Should I go ahead & report them now to OFT and trading standards? And should I tell them that I'm going to do this?

    Thanks

Yes tell them that if conformation, of no further action , is not
    received
    they will be reported.
  • Lowells are the sewer of the debt collecting industry...so when a debt gets passed to Muck Hall, you can rest assured that its sunk even lower than that & they dont have have hope in hell of collecting it.

    they will be reported.

I had another letter from Red today asking for payment again (they totally ignored the email I sent)
I've written a reply enclosing a copy of the letter from Lowell (August last year!) saying the account was closed and I wouldn't be receiving any further contact from them regarding it!
I've also stated that if they don't give me written confirmation of no further action then they will be reported to OFT and trading standards.

    - can't wait!
  • Hi - Had a letter from Lowell (not Red!) last week. They apologised and said it was an admin error which sent the 'computer generated' letters
(was it also a computer I spoke to on the phone?!?)

Oh well, lets hope that's the last I hear from them!
(but I won't hold my breath!)
