    what are your proposals to repay this rent ? - that is all i would be interested in as your landlord - whether the LL looked in his bank account or not, is not the issue, the tenant has not paid their rent and needs to come to an arrangement to do so

    re where is it written down that the deposit can be used to pay off overdue rent - its part of Landlord and Tenant legislation - i daresay someone else might be bothered to look up the reference - i dont need to, as i know the law in relation to this
  • originally i said i would pay 500 when i got paid on the 13th march and i would pay the remaining the next month, but if the LL agrees to use the deposit towards the arrears i could pay the rest off on the 13th march.

    I doubt its written in legislation, but its very common for a deposit to be used not only for damages but also to ensure the tenants obligations as regards to the tenancy, one of which will include payment of rent (common/case law rather than legislation). As the depsoit will be protected under one of the TDS schemes, a quick view at the various case studies will show umpteen occasions where the deposit has been awarded against unpaid rent.

    OP bung "can deposit be used for arrears of rent " into google and you will get loads of links all confirming this.

    As Clutton suggests, your main priority is to do a bit of arithmetic and agree with your landlord the amounts outstanding and come to some agreement about the payment of this.

    So, you want to leave the property and pay the 'first instalment' of the due rent 2 weeks later? Who says you just won't disappear from the horizon, looking from the landlord's perspective? You haven't paid for 6 months, after all.
    The deposit is there to cover any damage to the property as well, so you may not have the full £575 to use towards the rent arrears.

  • if i wanted to just leave i could have said i'll pay it all at the end of feb and just done a runner, instead i paid £225.00 to cover feb on the monday to show i would pay.

    The posters intentions to pay the rent or not, makes no difference. If he has served the correct notice, he can leave regardless of the rent arrears owed.
