Reclaim PPI St Andrews MBNA Advice Please - Policy exclusions?

    Dear Everyone

    I thought I would update this case and let you know what has happened thus far and that we are now at a crossroads on deciding how best to proceed.

    MBNA and St Andrews have been contacted by telephone again today and my friend spoke to countless departments (inc people who refused to give their names) as she is keeping a record of who what etc. They have maintained thier position on refusing the PPI claim and also when she has stated that she was therefore mis-sold the policy back in approx 1996; they claim to have sent a "re-phrased" policy update in 2003 which she says she never had!

    Where do we go from here?

    She is telephoning the FOS this afternoon to start that ball rolling.

    As so much of her monthly payment to this company is swallowed up by interest and PPI payment - only approx £40 comes off the total owed. She is desperate to get rid of this account as they have failed her so badly and behaved mercilessly.

    So I have wondered what her options might be now whilst off work or perhaps on returning to work? Can you please advise on the following?

    1) Should she now cancel the PPI payments? Even if it is being investigated by FOS?
    2) Would it be better for her to get a loan to pay them off completely? If so, could she negociate paying less as a full and final settlement.
    3) Whatever happens, she does not want to lose her credit rating so many options that I can think of are not suitable? Therefore, are there any other options?

    I will answer what I can but hopefully other posters will give their opinions as well here.

    You could ask the FOS about cancellation, as I was reading someone elses post yesterday and they were told by the FOS to leave things as they are while its in their hands as it could affect a future claim, but what they actually meant by that I do not know, so best to check with them I believe.

    Loan wise ask them for a quote first to see what the amount would be, and if she does go for a new loan, there are links above in the blue box for cheap interest rate loans.

    I believe this does not affect the credit rating, afterall she is only reclaiming in her own right and you cannot be discriminated against that, hopefully all this will be clarified by other posters.

    I also think all information is kept on data for credit checks etc and not sure if anything can be actually done about this, but again its another question where the FOS may be able to answer, good luck hun and hope everything works out well here.
