Loyds 2nd letter...next step court ?

Hi

i have recieved my letter saying they believe charges of £4000 are fair etc etc.

its saying " if you thinking of making a claim through courts, note we wil be asking the courts to postpone proceedings about charges until the conclusion of bank prcodeeings with OFT"

Do i still go ahead with the threat of taking them to the small claims courts with the letter template?

    Are you aware that the statute of limitations does not prevent you from claiming 6 years from the date of your first letter to the bank?

  • sorry i dont quite understand what you are saying. I def need the money to pay off other debts. do i ignore this and pursue my cliam for 4000 as its says on the video guide ?
  • Do you have rent arrears/mortgage arrears? Are you behind on council tax? Have you got behind on utilities?
    You do not need to file at court to have your claim paid when the OFT test case issues are resolved, however, no bank will pay out apart from hardship(I would say the definition on the ground is really extreme hardship).

  • i have 2 oustanding loans in massive arrears.

    It doesnt mention anything baout hardship in the video guide on this site? its just says go ahead and threaten court action and most of the time they will pay near the amount ?
  • I am awaiting my second letter from lloydstsb too after receiving the first one saying they are sending my letter to their recovery centre, how long did the second letter take to come Oliver16? I would be really interested to know this and also how you get on.

    It seems that lloyds drag there heals in more than some of the other banks, if i banked with say natwest im pretty sure i would be paid the money my bank stole from me.

    it was quick to get the response of they think the charges are fair etc. I think im going to do the 14 day court lettwer now as thats seems to be next step. I have 4000 so guess i will ahve to fight all the way - i just diont want them to close my a/c .!!
