Barclaycard and Chargebacks

I`m hoping someone can help me out.
I`ve bought a "buy it now" item from an ebay store and paid on my Barclaycard via paypal. The item has arrived damaged and the seller is refusing a refund.
I contacted Barclaycard to do a chargeback as i dont want to have to wait for paypal to solve the dispute and also disagree with their requirement that i should have to fund return of damaged goods to seller. (i`m happy for him to have good back but if he meets cost of this).
Anyway, Barclaycard have advised that there system refuses chargebacks related to paypal or ebay as the transaction isnt directly with the shop. They cant even send me out a form as this is one of the first questions that their systems asks, and once it is found to relate to paypal they advise that they are unable to help any further.
Can anyone help me out and advise what the legal position is with Barclaycard. I thought that they would be jointly liable as my CC provider.

You have asked Barclaycard to transfer your money to paypal. That obviously has worked. Barclaycard has no connection with your seller and thus no liability for quality issues within that particular transaction.
Only if the payment to paypal had gone wrong, would you have a case with Barclaycard.
Contact paypal! If you can claim that paypal has been at fault, you might try Barclaycard again.0 -

Problem is paypal themselves have not been at fault. It is the seller, but i thought that Barclaycard would help me as he is a business and i`m an individual. Has anyone had Barclaycard do a chargeback for them when relating to ebay or paypal?0 -
Paypal will usually refund you, once you have returned the goods via a trackable method. Exactly the same as taking stuff back to a shop. They wouldn't pay your bus fare to go back to a store...0

Possibly not but this is going to cost me £25 to return, which is more than a normal bus fare.
This is distance selling, i didnt go to a shop to purchase it. When amazon have damaged items they have met cost of return postage and i would have thought this shoudl not be passed on to buyer. How is it my responsibility when i had no way to check items were not damaged befroe they arrived?0 -

I agree with you, but unfortunately that's the way ebay/paypal work. The seller gets his goods back, you get a refund0 -
I've successfuly disputed an eBay/PayPal transaction through Barclaycard and they did a chargeback, but it was about a year ago, their policies may have changed now.0

Barclaycard can (have for me) and should even now at the end of 2010 chargeback in the right circumstances.
Paypal is the payment gateway. This is just the same as when you buy anything on the internet, whoever the company. Many large businesses use Paypal as their payment service provider.
I'm not surprised if they are told to try to put off chargebacks to eBay purchases due to volume, but the fact is they have done it for me and for my brother including in the past month.
But as someone who is also a seller on eBay, thankfully only ever had small scam chargebacks, do give the seller every opportunity to resolve things.
If an item arrives broken, advise immediately and give them the chance to claim for it being broken in transit - if it was covered. The onus is on the seller for it to be covered in transit. If they are prepared to refund your return carriage, don't expect them to pay that up-front - too many buying scammers for that.
Paypal deal with chargebacks very quickly now so that is a route. But your card should cover you.
But the best guide to eBay, buy from reputable sellers. Check their feedback, check their ratings, check their return policy, check if they are a personal seller or a business seller (distance selling laws). Buy wisely, then you hopefully you'll never have to do a chargeback.0
