Forrest, i am self employed and he works for me, am ltd so we both take a wage. the arrears acruded when he was self employed many years ago.
All i keep thinking is they cant take what we haven`t got!!0 -

Don't quote me on this but if the debt is acruded before 12/07/01 then the arrears can not be collected via the courts/bayliffs but only via Deduction from earning order. Phone up and ask the CSA these questions. If the debt is too old to collect via court and if the CSA can not put a Deduction from earnings order in place then the only way for them to collect the debt to phone your husband every now and again.......i know it doesn't wipe the arrears off but it may mean you can get away from paying it in the long run, plus the ex might get bored with chasing it.0

But it appears that when the full force of CMEC comes in, a court order will not be required, and so other action will soon follow. This may only be a brief respite.0

Thanks forrest, im going to get all the data protection stuff sorted and i will definately get a breakdown of when it was owed, but i guarantee hand on my heart, the ex wont get bored... This is what annoys me about the CSA, they say they are on nobodys side, but it is always in favor of the PWC. She can so blatantly break the aw and commit fraud and it is down to us to prove our innocense... it stinks...0

Just a thought but where did your husband get the cash from to pay his ex?

Its that long ago, the bank account no longer exists, been bankrupt its a no hoper... may just emigrate to australia, they wont find us there!!!0

Sharee this is what I used to get all info from the CSA. When It came I was surprised but as I looked through I found they had blanked out many names and other things I couldnt understand but copy this and fill in you own details and send it off they have to acknowledge your request by law and also have to give you the info. You may also request a compleate breakedown of accounts like how much they want/take and a breakdown of where it goes.

I request all computer and clerical records to which I am entitled to including all deduction from earnings statements, any arrears statements and all payments made to arrears, a copy of my assessment and would ask that the notepad sections of the computer files are dated.
If you need further information from me, or a fee, please let me know as soon as possible.
If you do not normally handle these requests for your organisation, please pass this letter to your Data Protection Officer or another appropriate official.
