Financial hardship claim - are they lying?

I believe I fit the criteria so called my bank. They told me because I had already put a claim in (back in August) that they cannot process this any further!!!!! If I wasn't happy with this to go to the Ombudsman. According to this website, it shouldn't matter if you already have a claim on hold. Anyone had this response from a bank?

Which bank is this? Have they stated they have rejected your application for hardship or they will not even consider it?0 -
Its HBOS. They say they won't even consider it because I already have a standard claim in (which I submitted last Aug). Its not a claim for financial hardship though cos I wasn't in that situation last year.0

I suggest you write to them and let them know, you wish your claim to be considered under the financial hardship guidelines from the FSA waiver. This should prompt them to request details of your financial situation, so they can consider whether you meet the criteria.
It matters not whether the claim has already been submitted or not. Peoples situations change, so whoever you spoke with is at best being obstructive.
If they refuse outright to consider you, or you are subsequently turned down, you can ask the Financial Ombudsman to look at your case.0 -
I wrote to my bank (HSBC) over a week ago, using the hardship rules as my reason for requesting that my claim be considered quickly. I hadn't heard anything so went in there today - the manager told me that he wasn't aware of any new hardship rulings and basically told me I was lying!!! Anyone else had this??0

There is no "NEW" hardship ruling. There is a waiver on banks dealing with Bank charges claims. The exception is hardship claims which are normally dealt with by a central bank team and would not be a branch that would deal with claims. If you already have an acknowledgement of your claim from the bank then you can at anytime look to have that relooked at if your circumstances change. The FSA waiver is on my signature, take a look especially PAGE 11.
