Refused claim and confused, now need ure help

First Direct refused my initial claim but I need help with a few issues they highlighted in turning down my request, can anyone give me advise please. They say that as my loan and PPI was agreed on 11 Dec 2004 and the only responsibility of their advisor required was to confirm I was a UK resident, aged between 18-65 and worked for a minimum of 16 hrs per week, also that due to the date above they only began to offer advice on the sale of the PPI from 14 Jan 2005 with regards to existing insurance/sickness pay cover ( which I had in place) and any reccomendations to my policy, and as such it was purchased on a "non advised" basis and thus my responsibility to check suitability. ANY THOUGHTS ON ABOVE WELCOME PLEASE OR ARE THEY TRYING TO BLAG ME. also what is this about change in law re 2005 polocies compared to polocies taken out prior to Jan 05, I look forward to any kind replies, Mike

    Do you know if these were covered regulated by GISC at the time, the FSA had taken over in Jan 2005?

    You do have a good case here.

    Do you have the agreement for this still ?

  • Thanks for response, it seems I do have a strong case. I contacted the FOS for some further advice. They were very interested in my case and have initiated an immediate complaints procedure on my behalf. I will follow up with the lender to inform them I do not accept their reasons and give them 14 days to review their decision.( Is this sufficient time for them to respond). Hopefully I will get a quick response. Would I be in breach of agreement if I stopped payments whilst this is ongoing as I wouldnt want to shoot myself in the foot.

    In regards if you stopped paying payments I am not too sure on the situation here to be honest, but if your struggling let them know, maybe an arrangement could be made and hopefully someone will post up to say your best options here for you about the payments.;) Hopefully this can be arranged without it affecting anything, fingers crossed.
