Financial Hardship claim - who wins????

Hi,
I sent my original letter to HBOS on 22/10/08 and after a long process of proving my financial hardship, they have offered me £840.00 from a £2880.63 claim. I am currently £325 overdrawn of which £290 are charges so in fact they will now pay the £840.00(if we accept) into that same account taking the charges back - so who is winning?? Certainly not me. I dont know what else to do. They have advised me to go to the financial ombudsman - how long will that process take? I am now 2 months behind with my mortgage, i dread the postman arriving every day as we are getting more debt collectors letters, my telephone rings and we dont want to answer. How much financial hardship do you have to be in for the bank to offer an amount which is enough to clear your feet and try and keep you afloat - I am losing heart by the hour. AAAARRRRGGGG!!!!:mad:. I have heard that in Scotland the courts are still hearing claims - is this true and how easy is the process???
