Who do i claim off

I bought a car on finance a number of years back now which i was told i had to take out PPI insuranece or the finance would not go through although i had an existing illness the saleman told me this would be ok and not to worry about it. I took it out and got the car. After about 12 months i was taken ill with my pre existing illness and tried to claim on the insurance as i could not do this the car ended up being reposessed as i was not able to work and therefore able to make my payments on the car.

The debt was bought by a DCA who i have now had the agreement written off with.

With regard to recaliming PPI who would i make the claim against would it be the original seller or the DCA who bought the bad debt.

    Have you the agreement to this?
    Any paperwork?

    If not write to them for a copy if the Executed Agreement under the section 78 of the consumer credit act 1974, they have 12 days to comply, this costs a £1 postal order or cheque payment.

    You could request a SAR (Subject access request) as well, there is a letter template for this on the thread you will find with details, but the agreement will be the main document here.

    We can take it from there if you want to or someone will post up to give some helpful advice, but the documents do play a good part in the reclaiming, please note though the SAR data/information they will probably send to you where they have 40 days on this to comply, you may only be send the data going back as far as 6 years, you maybe lucky to receive info going back even further, good luck with this and please let us know if you already have the above document/agreement for this, cheers.;)

    Thanks for that i already have all this information from the original company as they were going to take me to court and solicitors became invilved so already been sent the relevant paperwork of agreement and statements. The original company sold the debt onto a DCA and now after my solicitors told them the agreement was unenforceable they have written off the agreement.

    Right I see what you mean now, sorry to hear about this.
    I am sure there are ways around this, just waiting for the right person to post up on this for you and I'm sure they will.

    Okay I will bump this thread up now and again until someone posts in for you, I will keep my fingers crossed for you.;)

    A suggestion though, I know its a pain but you know what they are like pushing people from pillar to post, if that were me I would write to 2 of them and see what they come back with.
