Respond from catalogues after sending £1

Hello I asked both of my catalogues for my signed credit agreements enclosing £1 postal order, I received one from Lttlewoods signed in 2007 so they have to be paid. I received one from Kays saying I opened the account in 2004 but they cannot find the agreement.
the letter says:
We refer to your recent request for a copy of your agreement.

Unfortunately we are unable to locate a copy of an executed agreement, but for your information we enclose a copy of the current agreement which applied to this type of account. This version includes all contractual variations which have taken place.

According to our records the account was opened on xx/xx/04. You agreed to make payments every 28 days.

The outstanding balance is currently £xxxx.xx Our recordsshow that £xx.xx in payments have been made within the last 12 months.

In accordance with the tewms of the catalogue statements are issued every 28 days.

If third party is acting for you, please pass a copy of this letter to your representitive


Where do I go from here?

Can Anyone help please.

  • Check to make sure the agreement you received is correct, i.e. name, address, that the i's are dotted and the t's are crossed.

    As for the other catalogue, seems like they don't hold an agreement so I wouldn't think it's enforceable.

    When in 2007?
    If before 6th April 2007, then the prescribed terms need to be included in the agreement.

    As the other catalogue cannot provide a copy of an executed agreement, the debt cannot be enforced.
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    Thanks for the info, the other catalogue is signed on the 18th february 2007?
    Do you know what to look for?
    Also do I need to write back to Kays? if so what do I say?

    As the agreement was from before 6th April they must have certain terms on the catalogue agreement they sent you. (nice timing)

    It should have the APR and interest rate, the repayment structure and a note of the credit limit or how it is to be calculated.

    There is a 12+2 day letter on the site that i'll try to find that you should send if the CCA does not have all these terms.

    I cannot see any APR or interest rate, in other financial information it says.
    1. Total charge for credit £0
    2. Rate of interest - purchases on this account are interest free i.e. the rat of interest is fixedat 0%

    Did you receive the goods from the catalogues? If so, pay for them.

    If only life was so simple, I did offer payments to clear the debts and they refused them, so they left me with no other option than to look into whether they are fully enforcable, So if you can't make any helpful comments, keep your snide remarks to yourself, There for the grace of God go you! You don't know my position so don't comment.

    Don't post on a public forum if you don't want comments. Good luck with getting out of paying your debts. Since I've had the benefit of the goods and services I'll carry on making payments to mine, whether they accept them or not.

    Does it say how repayments are to be made on the agreement?

    I would send this to the Kays catalogue as they don't have a copy of the credit agreement. Note however that defaults may be placed on your credit file even though they don't have an agreement and therefore your permission to share your details with a 3rd party.
