"and had made all her mortgage and insurance payments."

Yet we see posters say to others on this site - "Don't worry, as long as you make all your mortgage payments you will be fine."

It will not be fine if you are caught.

I think that's how they USUALLY tend to be caught, by missing payments and drawing attention to the account. Looking at the circumstances I can't imagine how she thought she was going to be able to keep up with the payments.

Does anyone know the circumstances. I mean, how did the case come about? Did she default on the loan and was then investigated? Do they do that in every default case?

Yes, there must be more to it. The broker would surely be fined if the girl is being sentenced.

Shame they didnt tighten it all up a few years back - would have prevented our neighbour from hell, who rarely works, getting a mortgage on the place next door :(

    Two points:

    a) When are the banks court cases for not asking to see evidence of income ?(i.e. being negligent with shareholders funds)
b)Is the fact that this has made it into court proof that there can't be as many of these as people think i.e. if this was such a widespread problem how are the courts going to cope :D

point a I agree with :) point b...not so much, I'm not saying you are wrong that this isn't large scale...I don't know...but not reaching court doesn't mean its not necessarily happening.
