I don't see this as your issue.

Firstly, you should pay your rent arrears to the Letting Agency (always making sure you have proof that you paid), as you still owe this money, and someone is no doubt out of pocket here.

Secondly, as you already have somewhere to move to, then I suggest just to cover your own backsides that you hand in notice on your rental property, so that the owner doesn't try taking you to court for not giving correct notice, and thus chasing you for rent! (If he's broke, it's something he might try...)
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Or the lender in repossession takes action against you for.

I must say you are very lucky that the letting agent is finding you another property to rent, given that you have rent arrears on the corrent one!

""The court are not allowed to consider the tenant as they are considering the case between LL and mortgage company.""

i have known several cases whereby tenants have gone to court and been listened to by the judge and have been given time to find somewhere else to live.

Agreed. Make sure that you go to the Court for the hearing.
