    All forms of public announcement can be withheld by order of the court - ive had to apply twice to the court myself - and won both times ! Makes a change !

    5.7 Stay of advertisement (bankruptcy)

    Where there is an order suspending action by the official receiver under rule 6.34(2) or 6.46(2) (preventing all publicity of a bankruptcy order) and as a result no gazetting or advertisement of the bankruptcy order has taken place, the former bankrupt can still request an annulment to be gazetted. There is no provision for advertisement in such a case, as rule 6.213(3)(b) provides for such an advertisement to be placed only in any newspaper in which the bankruptcy order was advertised.
    The official receiver will need to be aware that rule 6.208 gives power to the court to make an interim order (in advance of a hearing for an annulment) staying any proceedings "which it thinks ought, in the circumstances of the application, to be stayed".
    In the case of a stay of proceedings or of a stay of advertisement, Audit Section General Processing Team should be telephoned immediately.

  • Debtdoctor what does actually mean in laymans terms please. The only worry I have of going BR is that it will undoubtedly put my parents in hospital with the shock, worry ect due to their ill health and I do know that the type of people who know them would take great delight in informing them, and I am thinking of asking whether they could keep it out of local rags.

    Just because it may be in the local paper doesn't mean it will be in the local paper. Check you paper and see if they even print those type of announcements.

    Stay of Proceedings are more common in creditors petitions where the person is contesting the BR Order and/or is seeking an annullment.

    Most common reason for a judge granting on the BR Order for address not to be published is domestic abuse, I doubt they will agree in the OP's circumstances but you can ask the judge on the day.

    If you wish for it not to be published then you would need strong evidence to support your request. My post was to show that non publication can spread further than just the local paper. The two sucessful reasons for my clients were that one of them was a witness to a serious crime and re housed by police / local council under witness protection program, the other being a prison officer in a category one prison.

  • i went br 18 dec and they have the section in my paper but im yet to be announced and its up to end of jan now so think ive been forgoten
