right quick question from a long time lurker
i have a van through a contract hire company provided to me by my company although it is in my name,not owned by the company jsut leased to me though maincrest.

i a, fuly comp insured on my car and my borhter is fully comp able on his car able to drive any other car 3rd party

today we was driving to the tip my brother was driving the van with my permisision and basically nasty police man was being difficult saying about insurance and waht not and basically about permission to drive.
as far as im aware im allowed to drive and so is anyone with my permission,he is name on my company fleet insurance aswell as off a few weeks ago when i got the paper work though from my company,

so even if he wasnt on my comapny insurance he wud stil be coverd at least 3rd party anyway on the van, am i right?

the copper let him go after talking to me on phone aswell as i was already at the tip at this point and i told him it snot owned by the company i work for its jsut leased to me in my name so i have the permission to let anyone i choose use it surely aslong as they are adequetly insured which in this occasion he was coverd with two insurances.
he said he was going to call my company and ask them during next week now im dreading iv done something wrong? have i? help!

  • Does your brother have driving other cars extension on his comprehensive policy. Also the Van has to have insurance as well.

    Driving Other Cars is often exactly that, CARS. It doesn't extend to minbuses, motorbikes, lorries, or even vans.

    There's nothing you can do about it now anyway.

  • its a astra van basically a car! yes my bros policy has 3rd aprty extension to it as he called them,the van is coverd under arval fleet insurance im a field engineer and can dirve the van in and out of work hours, vehicle is mini leased from a company via norflex fleet managment in my name under the company but i sign for it and are responsible for it.
    he is named on company insurance docs that was sent abck a few weeks ago,so i would have though we he would be coverd by two insurances? 3rd party on his and then fuly comp on the companies?

    I think what the policeman was doing was saying that your boss's fleet policy which I assume is cover for any authorised driver (Probably over 25). If the policy is like this the wording for description of what drivers are covered is normally "Any authorised driver with the policyholders permission providing they have the correct licence" I think the policeman was being pedantic that your brother did not have the policy holder eg your bosses permission to drive the vehicle.

    If you want to avoid this in the future ask your boss for a letter agreeing that either your brother has his authority to drive the van or that he gives his authority for you to allow other people to drive the vehicle.

    The other possibility (Sorry I can't be more accurate but the details you have given are not that clear) is that the policy has a restriction as to what the vehicle is used for. This is probably says "Social Domestic and Pleasure Purpose and IN CONNECTION WITH THE POLICY HOLDERS BUSINESS" The policeman may have assumed your brother was using the vehicle for his own business eg tipping his own businesses waste and therefore was not covered as business use is only for your Bosses Business. If your brother was using it for Social Domestic & Pleasure purposes eg dumping his own household waste then he would be covered.

    The other option is some police officers do not fully understand how the Motor Insurance Database works (This is the computer the police use to see who the vehicle is insured by etc). On a policy that covers any driver the Motor Insurance Database shows under the section drivers covered it says "No restriction shown" (If it was a normal policy covering you and your wife it would state their names. I have had police officers who did not understand this and thought the driver was not covered as it said "No restiction shown" and they would not believe me this is how it works even when I gave them the Insurers telephone number to confirm it.

    As stated by quote te driving other cars section covers driving other Private Cars, your astra van would be classed as a commercial vehicle as the log book will class it as a car derived van so he would not be covered under the driving other cars section

    I hope these may offer some options as to what the police officer mean
