NIP for red light contravene

Hey all

My mum has just had a NIP through post for contravening a red light. She has no recollection of driving through the said light on a red, and it's unlike my mum to do this intentionally.

However on the day in question there was a shedful of snow and she remembers one of the traffic lights on this road turning amber as she was almost at the white line, but due to the icyness/snowiness of the road she could not break safely enough to come to a stop (without sliding on ice into the junction) so went through the lights. We are assuming that the light must have then turned red as she passed through it, hence the NIP.

Anyway she is wondering what the likely fine/points would be as this is not stated on the NIP.

I do not have a scanner so cannot upload a copy.

  • Yep, I had one recently. Similar situation, except it was raining heavily and I had a car right behind me. I asked for photo evidence, but there was no arguing it. I was positive it was amber. I checked out some other forums and they all said it's pretty impossible to appeal. Sorry

    They'll probably tell you after you respond to the NIP.
    A friend got one recently and was offered a driving awareness course as an alternative. (Depends if your force use them and perceived severity of offence)

    It cost him about £85 I think - half day course. but advantage is no points on licence.

    But the point is that it shouldn't have been out of her control.

    When approaching lights you should always assume they will turn red, and leave enough braking distance to do so - which will be more in the snow. ;)

    The problem is they will then say she was driving too fast for the conditions which would also be at least 3pts and the £60 fine.

    Is this just the NIP or is it actually the ticket as well ?

    If it's the NIP, you could still have to wait another 6 months for the actual ticket. Until you get it there is nothing you can do. You might be lucky and they screw something up and not send through the ticket.

    I'm not sure they do the course unless you are asked to appear in court in person. Also if this is the only 3 pts she has there is a good chance the insurance company won't even change her premium.

    The prosecuting authority will say that your mum should have been fully aware of the road and weather conditions and therefore should have adjusted her driving accordingly. I presume she was snapped with a red light camera and that they have a photo?
