Homebuyers report

I had a Homebuyers report carried out before I purchased my home a month ago.
It is a detached house.
It turns out that we have a leak in the basement coming from a small crack in the side wall (probably coming from the drains outside) creating a puddle of water on the floor. Why did he not see that the basement floor is all wet?
My surveyor recommended the usual damp report but did mention the leak or wet floor. Do you think he'll get away with it because it wasn't a 'full structural survey'?

Must have been the same guy who failed to notice the kitchen floor was under an inch of water in my house

I think they get away with it as they always say they advise you get a electrician report, plumbers report etc etc etc0
