Partner has got bailiff letter

hi
my partner has received 2 letters today from dukes, saying 'we think we have traced you to the above address please contact us immediatly'. its regarding a couple of parking fines that were being sent to his mum and dads place. my partner had his old car parked on their drive overnight and these bailiffs took it, luckyly we had a new car. they've already taken the previous car so i'm damned if i'm paying these anything. (btw he got these on a hospital car park where he was working, building the new maternity unit...nice huh?)
i dont drive, and am not insured can i just register our car to my name? also we're a yr into a hp agreement on it, so they cant take it???
i know this forum is about paying off debts, but they've had our previous car :mad:, and i fear my other halfs temper will get the better of him if anyone turns up and clamps the car

Strange one this, Did anyone see the bailiffs take it. Are you sure it has not been just stolen. Bailiffs can not take anything away until after a court order. Parking tickets can only be enforced if issued by council or police so
it is very confusing. Wait a little while longer and someone much more experienced will be along to help. In the meantime, have a look at the Pepipoo website regarding parking charges.make the most of it, we are only here for the weekend.

yeah they clamped it first, i rung the bailiff and he said if it wasnt paid by midday he'd tow the car (which they did), it was issued by stoke city council0

Bailiffs cant take anything thats on HP as technically you dont own it.
How much are the bailifs claiming is still owed, do you have a breakdown of the charges?0 -
If it is a council ticket then thats a different matter, still a court order would still have had to be issued. If letters had been sent to his parents house then why havent they been passing them on to your OH. There probably has been a judgement in that case, Dont think you have a leg ot stand on tbh, Your other half may be angry but he has no one to blame but himself for not paying the parking fines promptly therefore avoiding all this. Best thing to do is just pay up and move on
Every time bailiffs attend there are more charges added to the debt.make the most of it, we are only here for the weekend.

he's got two letters, with two different ref numbers and two amounts, one for £365.49, the other £263.01, no breakdown0

They can't take the car so long as it's on HP - don't know if they can clamp it though. HOWEVER they will not go away so you or your OH have to deal with this - whether they took your previous car or not really doesn't matter much. They have now tracked you down to your current address so they will continue to hound you. Why didn't your husband pay the fine when he first got it?
Best bet NOW is to contact them, request a full breakdown of charges and what amount was paid with the sale of the old car (if any - bear in mind that they will have taken off any costs of taking it away and auction fees etc). There is no need to - so long as it's on HP they can't take it - and it would be an issue with his insurance potentially if you are the registered owner of the vehicle... and I'm not actually sure you would be able to do it quick enough if they already know where you live and the car is...DFW Nerd #025DFW no more!
