Taking a hardship case to the FOS

Hi all,
As Halifax are stalling, we are taking our case to the FOS.
I have added the following to the FOS complaints form in the other details section.
Do I need to add anything else ?
Any help much appreciated
" I have asked Halifax PLC to to consider my claim under the FSA financial hardship waiver issued in July 2008.
Halifax have at no point asked for evidence of my financial hardship, their only mention of this is in their letter of 31st December 2008 in which they state “We acknowledge that you indicate that you are experiencing financial difficulties”.
It is possible that they have accepted this due to my salary (which is paid directly into my account with Halifax) has been reduced by 40% in the last 2 years, they have downgraded my full current account to a basic account and I currently have a reduced payment agreement on a loan with Halifax.
My claim is for £4,806.41 and I have also offered to settle for £3,250, which has been ignored by Halifax PLC."

According to the FOS the bank must give you their decision on whether they believe you are in financial hardship or not within 8 weeks of you notifiying the bank that you think you are. If they either don't, of respond negatively you can ask the FOS to adjudicate.
The waiver direction states that banks should be active in filtering and identifying hardship cases. The criterea that banks should follow for defining financial hardship is set out in the FSA waiver direction under annex 2 http://www.fsa.gov.uk/pages/Doing/Regulated/Notify/Waiver/pdf/disp_monthly.pdf0
