Account in dispute - What are my rights?

Hi guys,

I'm hoping that someone may be able to help me...

I've got an old HSBC bank account with about £350 in charges etc. I put the wheels in motion to reclaim in July 07 shortly before the beginning of the test case, I was promptly replied to by HSBC stating that they'd put my claim on hold pending the test case completion blah blah... but last year they started pestering me to pay it back...I sent a few letters stating that as the account is in dispute and I will repay the amount (or not) pending the result of the test case which they didn't seem to understand and as a result recently passed it to a debt collection agency to collect the full amount.

As a goodwill gesture; I paid £100 which was the amount of my original overdraft, leaving the remainder amount made up of charges...now the debt collection agency want the rest....I know I have rights and shouldn't have to pay anything from my account if it is in dispute...can anyone tell me what my rights are so I can get a pretty watertight letter sent to the Debt collectors please??

  • The debt collection agency should not touch it with a bargepole. Write a letter to them and state that the debt in currently pending the OFT test case and you have had an acknowledgement from HSBC. Update your charges sheet and send an updated one if there has been more charges.
