If your agreement is periodic (ie rolling from week to week or month to month), you normally have to give at least four weeks' notice to end it, or a calendar month if you have a monthly tenancy..It is always best to give notice in writing and ensure that the notice ends on the first or last day of the period of a tenancy. For example, if your tenancy is monthly and started on the fifth day of the month, the notice you give the landlord should end on the fourth or the fifth0 -

i have been renting for 15 months and my tenancy aggreement was for 6 months i havnt renewed my contract and am looking to move out in my agrreemeny it says i have to give 2 months notice do i still have to even though i havnt renewed my contract?? someone help me plllllleeeeeeaaaaasssseeee!!!0

even if tenancy says 2 months the law says only one month - ending on last.or.first-of-period-day.. so if tenancy runs from (say) 10th of month to 9th of month and you give notice today it can expire on 9th or 10th October. LL must give 2 months notice, similarly0 -

I have read the above but so i get it straight in my head:
I am a periodic tenant and we pay monthly on the first of the month. We have given notice today (15/09/10) to our landlord. We gave a month so expected to be able to move out on the 14/10/10 but our landlord has said we can not end the agreement until 31/10/10. That's is effectively 6 weeks notice.................Is this correct??????

Yes, it's at the LL's discretion if they accept a month's notice from any date. Many good landlords will accept a straight month from any date - especially if you've been there some time.Folks,

You need to read your contract carefully really, whereupon you will most likely find it speaks of the rent date being the notice day, but there will be others that do allow just a straight month from any date.0 -
legally a landlord can expect to receive a full calendalr months notice ending at the end of the rent period as specified in the tenancy agreement....0
