    Oh Thanks 10past6, for understanding me!! Thats kind of what we've done, OH said to put down how much we could offer per month but l said NO!, as we'll be paying 2 different companies for the same debt!.Bless him, he was trying to get his head around it!! But now finally done it! It took me a while.

    Although this has really scrambled my brain trying to figure it all out, l feel it has been a learning curve and hopefully eventually l'll be able to support others in similar situations. l've learnt so much from you and other people, it gives me confidence to deal with the debts rather than hide them all under the carpet!!! X

    Going back to your situation I've given this scenario before, if you borrow money from Asda, what right has Tesco got to come and claim the money from you, you never borrowed it from Tesco, and that's where you're at with this litigation case.

    Yes thats right. The other thing that bothers me is that in a letter cl sent us just before xmas, it stated that we had a ccj against us from them, we never had any notification of this and have put all this in the letter to the court and given them a copy of the letter, it was quite intimidating. lf they have given us a ccj could we have it removed? As the debt should'nt hae been with them.Having done some research it sems cl dont play by the rules and one case was struck out of court as they didnt have the cca. l hope, given the circumstances, this happens to us.
    Fingers crossed, l'll keep you posted on this one.lm quite scared,because it involves court but l cant just let them walk all over us but l think its what the companies want

    Hi Everyone,
    An update for you, we heard from the court today and the judge said unless the dca files their AQ in the next 7 days the case will be struck out, Yipee!! This is still a confusing one but l wont hold my breath until l know for sure, but think we're one step closer to wining this one!!
    Thanks to everyone that has helped me along the way.

    Well done so far nova, very, very, important:

    On the 7th day at 3:55 phone the court, ask to speak to the court MANAGER.

    Confirm whether the claimants have replied or not, if NOT, request the court MANAGER stike out the claim as per the judges instructions.

    Sorry to sound thick as per norm!!! it says 7 days from the date of service of this order, l assume they mean the date thats on the letter (23rd Feb)? So that would be up 2nd March. l shall make a note in my diary.
