GE Money Court!

Hi All, l just need a bit of advice really, as some of you are probably aware l put in a claim through mcol against ge money, then 4 days later they put one in against me for the same account.

l have recieved an AQ to fill in as the defendant, but in the post also recieved an offer of settlement as the claimant. (with me so far!!)It seems a clear case of their left hand doesnt know what their right hand is doing.
My question is shall l treat them as 2 separate claims or do l tell them about each other?
At the mo l've 2 separate piles on my table so as not to get confused, although it's easily done with me.!!

    Hi, l have about 3 accounts with ge money (store cards, l know really bad isnt it) but managing them ok.This one thats ended up on the court route is actually OH's only lm dealing with it as he's at work. The reason this one has got to this stage is because it involves mis sold ppi, we've exhausted all other routes ie ombudsmanand now ended up at court.

    can you post up the default letter(s) for 10past 6 to look at and the date of any termination letter?

    Thanks for getting back Ras, am l past the default notice stage though? l cant post it at the mo as there's not a child in the house to assist!!

    l dont mind dealing with the court (well OH will!) l just dont know whether to tell either solicitor about each other! As OH is both the claimant and defendent. The one where OH is the claimant, they want to settle out of court, although we dont agree with their offer, and the one where OH is the defendant, they have completely ignored the defence he put in and have said he already has a ccj against him. We have written as you suggested to find out when and where it's registered, if at all!

    Hi All,

    l've just thought of something, if we're diputing this debt, ie taking ge money through mcol, would'nt that automatically mean the debt can not be passed on to a dca, as this is whats happened. We've claimed against ge and are now in negociations to come to a settlement and the dcathey must have passed it on to are taking us to court.

    Any thoughts on the subject?

    Hi All,

    Just thought l'd tell you what we've done,as this is so confusing lm not suprised l have'nt had many replies!!

    Filled in the AQ as best as we can with the information we have. Also put a covering letter to the court stating that we are in negotiations with the original creditor to come to some arrangment.
    It does seem that courts are not keen on having their time wasted and we're hoping that that is what they think this DCA has done as there has been some lack of communcation somewhere.

    l know this is a complex situation but could somebody please give some reassurance that we have done the right thing, Please!

    Hi, our case against them is not settled yet, they've made an offer and we're writing back to see if we can get a more favourable offer.

    The claim against us is the DCA CL Finance, that the debt must have been passed to, but as l understand it,it should'nt have even been passed on, as this has been in dispute since Jan 08.

    So what you need to do re that claim is deny it on the grounds the you have NO account with the claimant, the account number they refer to relates to an account you have with another creditor.
