DCA chasing an account in dispute

Hi! I would really value some advice on the following matter. I had an account with a bank and in July 2007 I made a claim for charges (which has been stayed pending the outcome of the test case). Recently I changed over to another bank and left the old account dormant. When I took the last of the money out of the old account I did not factor in a debit card transction which took a few days to be debited from the account. As a result the account went into overdraft and they obviously applied charges which have accrued over the last few months. I recieved a letter from a DCA claiming this amount and I wrote back telling them that the account as a whole was in dispute and that I wasn't going to make any payment until my case had been decided. I just need a bit of reasurance. My question is whether I am enititled to regard charges applied after I lodged my claim back in 2007 as being in dispute?

i assume your charges claim is greater than the now claimed debt?
if so then you must tell the DCA the debt is in despute and they must return the debt to your bank.
this is a condition of the banks waiver.
if you can afford to pay the debt personally i would pay it to reduce the risk and subsequent problems of the bank making adverse credit reports on the account.
if you are in financial dificulties consider making a new claim to your bank as such.
