Renting question regarding early termination

Hello

Hoping someone here can give me some advice, My sister moved into a new private rented home 1 week ago, the council this week has decided after 6 years of waiting to offer her a house. She has spoken to her LL and they have told her that she will have to pay 6 months rent....is there any way she can get out of this i.e cooling off period or a 14/28 day change your mind option? I have never been in this situation so have no idea....will be speaking to her soon as right now she is looking thru her contract.

Any advice would be good.

    She has signed a contract and she is bound by the terms of that contract.

    The best way to try and 'get out' of that contract is to negotiate with the LL to accept an alternative tenant.

    That could either be one that she finds for the LL (and is acceptable to the LL) or one that the LL finds through advertising. In the latter case, expect your sister to be liable for re-marketing costs and in both cases she could find herself liable to other costs the LL experiences (e.g. legal costs in preparing new TA, lower rental a new tenant may pay, etc)

    Apart from that, the LL cannot charge your sister rent for a period that another person is renting, but he can charge up until that new tenant is paying.


    The only other possibility is that there is a break clause that could apply within the fixed term, or no fixed term at all specified within the TA - both are unlikely to be honest, but worth checking.

    Is your sister in receipt of housing benefit/LHA? If so, she should talk to the local office about "overlapping" benefit to help cover notice periods.It wouldn't cover the reminder of a 6 month let but it may help.

    If a new T can be found for the private let (one who is acceptable to the LL) thenyour sister will only be obliged to pay her rent up until the time the new T moves in, plus the LL's reasonable costs for readvertising. She needs to talk to the LL asap and get him/her to get the property readvertised
