Hi
I put a claim through MCOL on the 26th January which cost me £80 trying to claim £2500 from Lloyds TSB.
They gave lloyds 14 days from the 1st Feb to reply. They replyed as soon as yesterday with defence. This morning I have recieved a letter from Sechiari, Clark & Mitchell solicitors on behalf of lloyds. It says on there that they are asking for a stay (postponement).
I am really unsure of what to do now as they have asked me to let them know if i will agree to this?
What will happen if i do or dont? Have I just wasted £80 of money I havent got....
Please Help Thankyou

If the case is lost, then yes. That is what happens with court claims.
If the case is won, you will be entitled to the £80 back. Don't expect anything to happen anytime soon0 -
hi
on the positive side you havnt wasted anything if the OFT win the case and youve secured your claim plus a free savings plan on the amount at 8% interest.
isnt all done till the courts say so.

I dont understand this, so they will still put a stay on the case if we are under financial hardship? If so then whats the point of the financial hardship rule?
Or is this case not anything to do with the financial hardship rule?
I would be grateful if somebody could explain as i just sent my first letter and got a reply explaining that it was being forwarded to andover recovery centre and i would hear something within 4 weeks.0 -
hi
the courts will not proceed if your in financial hardship or not. the banks may help. the usual recourse if the bank do not help is to take your case to the FOS. as you have already started your court case im not sure the FOS will deal with it. in some circumstances if your bank agree the FOS may take your case on.

Years yet I think. Will be appealed whatever the decision.0 -
So in my case where i have just sent my first letter and explained financial hardship, the bank sent a reply telling me they are forwarding it to their Andover recovery centre, if i am not happy with their solution i can then take my case to the FOS? If this happens what are my chances with the FOS are they forcing the banks to pay any of this stolen money back at the minute? I am genuinely in a case of financial hardship after the company i work for going bust. Now i have had just had a letter telling me i was £40 overdrawn for 7 days and if i am reading it correct then i will be charged £15 for each day that i was overdrawn, this is crazy. It infuruates me infact! Sorry for ranting a little but seriousley what are my chances of getting my money back when i really am in a desperate situation. When the banks got in a mess they got my tax payers money no problem and yet they still treat there customers that have been loyal customers for years like this it is utter BS!

im exactly the same, i actually cant afford to pay the charges they keep giving me as im unemployed with 2 young children. its adding upto about £175 a month in charges its disgusting. ive asked for their help, but they wont as they are too pbusy lapping it up. im sick of it. i see all the sucsess stories people have had with lloyds, who have gr8 income. why cant they give us our charges back?
driving me mad0
