Council Tax - Ex housemate won't pay up

Hi people.

Just wanted to share a problem with you as I know you are all very helpful here.

I was living with 2 other guys (Andy and John) in my last place but we still owe the council some money for tax. The bill was £249.81 which would mean that each person would pay £83.27 each as to be fair. Now I've payed my share and so did Andy which leaves £83.27 unpaid for. We have both approached John and asked why he hasn't payed but he insists that his rent included council tax and that he wasn't going to pay any more.

I had an arguement with him today about it and he genuinely doesn't care about it because he knows that he will be going to be going back to New Zealand (as that's where he's from) at the end of the month and knows that they won't bother chasing him for it and chase the two of us instead. As all of our names are on the bill and therefore are all liable to pay for it which I think isn't fair as Andy and I have paid our share.

Any ideas what I can do or get John to pay up?

This must be paid by Friday so I only have tomorrow to sort it out and I really don't want to pay for his share otherwise we get another £55 charge for court action. It looks like I have no choice. :(

    Seriously though, you are going to end up paying this. The council will have no choice but to chase you for the money. Sorry.
  • You have "joint and several liability" for Council Tax, which means that if John doesn't pay up then you and Andy will be chased for the balance owing. I have been in this situation twice before. I got the money by saying that I was taking legal advice regarding the situation and threatening taking them to the small claims court. It worked, but I had more than a couple of days to sort it out....
