            Is your OH the only person doing that job? Do they have other vacancies?
Even if it is 'his' job, they certainly can advertise. That way, if your OH wins his appeal and is re-employed they just won't appoint from the recruitment. If your OH loses and stays sacked, they will hopefully have a successful candidate from the recruitment, and they won't have wasted weeks of being a worker down.

ACAS should be able to direct from here, I can see this has been mentioned on here but they should not have sacked him over this, I assume you have wrote a diary for this, dates, times etc.
I am so sorry to hear this and hope this resolves, the company are obviously trying to get out of this in case compensation is sought, but go for it anyway I would say, afterall this was an accident and certainly not your husbands fault here.

            You need to take a close look at his contract regarding diciplinary procedure.
The most important thing is his length of service. Under 12months he has next to no rights to be honest. Under 2 years is better but still a little sticky. Over 2 years and he is well protected with the following.
They have to follow this to the letter. In my experience the only thing that warrants instant dismissal is things deemed Gross Misconduct such as stealing or Fighting.
Has he signed a document telling him to leave open the shutters at all times.
Only failure to keep to a signed agreement would only allow them to issue him a 1st written then 2nd and so on. Finally a Final all these would have to be for the same offence.
They must also treat and be seen to treat everybody the same so if others left the shutter down them all should lose their jobs.
Tell them you will take the case to an employment tribunal for unfair dismissal. They will not have a leg to stand on.
Speak to Citizens Advice I think they will reprsent you.

Hi he has 5 years employment with them, so he should stand in good stead. Its hard enough for people to find jobs nowadays with the economy and it is so annoying that companies can sack people just for not putting a shutter up. If he doesnt get his job back we will have to go on benefits which I dont want to do but we wont have any choice.
