Hardship & Bank charges

Hi,
Hopefully someone can help me.....
My partner put in a claim with HSBC just before the court case started 2 years ago. Her claim was put on ice as with everyone else.
She has recently been made redundant from her job and is now in receipt of JSA.
She wrote to them to ask for her case to be looked at, and they replied with a letter and their financial difficulties advice book which you fill in with income and expenditure. She called them, went through it all and they agreed that she will be about £600 per month in the red.
They will not take her claim any further unless my income and expenditure is also disclosed also.
We have no financial ties except a joint savings account for holidays etc. which needless to say is empty just now. I own the house we live in.
Can they do this?? The charges were purely hers and before we got together. The keep banging on about assessing household income, yet this is a personal claim for her only.
